(June 14, 2025) – Vice President Sara Duterte is still obligated to respond to the original articles of impeachment transmitted by the House of Representatives despite the Senate’s decision to remand the documents, a legal expert said on Friday.
Atty. Michael Yusingco, senior research fellow of think tank Ateneo Policy Center, explained that the Senate returned the complaint to the lower chamber to request formal certification, including if the latter complied with the one impeachment per provision in Article XI of the 1987 Constitution.
“Ang sagot ko sa tanong mo [Chiqui] is ang sasagutin ni Vice President Sara Duterte is still the articles of impeachment na napadala ng House nung February,” said Yusingco in One PH’s Sa Totoo Lang interview with Chiqui Vergel.
Yusingco furthered that the impression the Senate had rejected the charges was misleading.
“Nagkaroon lang ng parang drama doon sa pag-remand kasi ang lumalabas parang may utos na review niyo [House of Representatives] ‘yung articles [of impeachment] pero kasi, ang order is just to issue the certification na dumaan nga ito sa tamang proseso at ito ay constitutional,” he said.
On Tuesday, the Senate, as an impeachment court, returned the articles of impeachment to the House of Representatives. The move received mixed responses and sparked confusion over the case’s status.
In response, the lower chamber certified its constitutionality.

Earlier this year, a record 215 lawmakers in the House of Representatives ousted Duterte due to her alleged irregular confidential funds spending and grave remarks against the Marcoses, among constitutional violations.
Sara Duterte, the daughter of former president Rodrigo Duterte, is the first vice president to be impeached.
Yusingco, meanwhile, criticized the “unconstitutional acts” by several senators for publicly commenting on Duterte’s impeachment despite their expected role as judges in the impending trial.
“Umaasa ‘yung Constitution natin na ‘yung mga senator-judges kapag binigay na sa kanila ‘yung responsibilidad even before they take an oath, ang mananaig sa kanilang isip is ‘yung public interest, which is neutrality, impartiality, and fairness, so dapat hindi sila nagco-comment,” he said.
