(April 20, 2025) – The Court of Appeals (CA) has upheld the conviction of a police officer who planted evidence and tortured two male teenagers during the brutal war on drugs of former president Rodrigo Duterte in 2017.
In a ruling issued on April 10 but only released on Saturday, the CA affirmed the decision of the Caloocan Regional Trial Court in 2022 to convict Jeffrey Perez for planting drugs and guns on 19-year-old Carl Arnaiz and 14-year-old Reynaldo “Kulot” De Guzman. Both were tortured before being killed, based on forensic findings.
Perez was sentenced to life imprisonment.
“When all the circumstances and pieces of evidence are taken together and not nitpicked individually, they paint the complete picture that the accused appellant was indeed responsible for the injuries suffered by Carl and Kulot,” said the CA in its 50-page ruling, as quoted by Philstar.com.
It also cited the inconsistencies in Perez’s testimonies.
“By planting drugs and a firearm, they attempted to create a post-fact justification for the shooting, portraying Carl as an armed suspect rather than an unarmed, restrained victim,” added the CA.
In his appeal, Perez contended that the prosecution failed to establish his guilt beyond reasonable doubt, stating the absence of direct eyewitness testimony and inadequate evidence.
De Guzman and Arnaiz, who were neighbors in Cainta, Rizal, went missing after going out for a snack on the evening of August 18, 2017.
On August 28, 2017, Arnaiz’s body, meanwhile, was found in a funeral parlor in Caloocan with several gunshot wounds. On September 6, 2017, De Guzman’s body was found in a creek in Gapan, Nueva Ecija with 30 stab wounds and his head wrapped in packaging tape.
The Philippine National Police claimed that Arnaiz was killed in a shootout when he fired at police officers after robbing a taxi driver. Human rights groups, meanwhile, alleged that De Guzman was killed to prevent him from testifying on his friend’s murder.
“The heartbreaking losses of their lives should act as a rallying cry for reforming law enforcement, enhancing judicial oversight, and ensuring that no further lives are claimed by those who are meant to protect,” said the CA.
Duterte is detained at the International Criminal Court for alleged crimes against humanity during his deadly war on drugs.
