(March 17, 2025) – The six-month period before the confirmation of charges against former president Rodrigo Duterte is fair for both the prosecution and the defense, an official of the International Criminal Court (ICC) said on Monday.
Atty. Kristina Conti, assistant to counsel of the ICC, said the timeframe is not unusual and ensures that both sides have enough time to prepare their respective arguments.
“Ayon sa sariling patakaran ng court (ICC), after that initial (pre-trial) appearance, the confirmation of charges should be held within four to six months. Dito naman (sa kaso ni Duterte), maximum period ang sinet kaya fair ito at inaasahan na namin,” said Conti on One PH’s One Balita Pilipinas.
She added that the defense could request an extension, but it must be based on valid circumstances.
“‘Yung ebidensya ay may period of time para ibigay sa kabila. Minimum of one month kung hindi ako nagkakamali, makukuha mo lahat,” said Conti. “Ang defense, inaasahan magsampa ng mga mosyon gaya ng interim relief. Puwede rin siyang mag-file ng mosyon para sa questioning the jurisdiction of the court.”
Duterte is facing charges of crimes against humanity over his deadly war on drugs, which reportedly left 30,000 dead. His pre-trial hearing took place on Friday. He’s currently detained in the ICC’s custodial facility in The Hague, Netherlands.
Conti earlier said requesting an interim release or temporary freedom will not be easy for Duterte because he’s a “flight risk.” She also noted that they are prepared to oppose any bid for an interim release.
Duterte, meanwhile, is waiting for the Supreme Court to rule on his three petitions, which are all seeking to challenge his arrest, detention, and turnover to the ICC.
“Isinasantabi na namin itong habeas corpus case dahil ang tawag nga namin, dead in the water (na ito). Ang tanong kasi ng habeas corpus, sino ang may hawak? Pupunta doon at sasabihin bakit naka-detain ‘yung tao? Hindi na hawak ng Philippine government (ang kaso) at pangalawa, may dahilan para kunin or arestuhin ‘yun. May warrant of arrest ng ICC,” stressed Conti.
