(August 19, 2021) – A panel of prosecutors under the Department of Justice (DOJ) on Thursday have once again indicted the suspected Eastern Visayas drug lord Kerwin Espinosa along with 10 others, this time over the conspiracy to commit illegal drug trading.
The DOJ noted in its resolution that there is no need to present material evidence of illegal drugs to establish the existence of a drug trade.
“Clearly, due to the complexity of transactions alleged in the instant case… it is sufficient that the communications among and between the respondents are established to prove the illegal trade,” the prosecutors said in the resolution made on July 23 but released to the public on August 16.
Espinosa, along with Marcelo Adorco, Jose Antipuesto, Jose Estrera, Galo Bobares, Ferdinand Rondina, Brian Zaldivar, Rosalia Canin, Virbeca Diano, Alfred Batistis, and Josela Dumaguit have been charged for the violation of the Comprehensive Dangerous Drugs Act.
The DOJ accounted for Kerwin Espinosa’s confession in December 2016, in which he admitted to selling illegal drugs in a barangay in Cebu City starting in 2004 until he was caught by authorities in 2005.
When he was still detained at the Bagong Buhay Rehabilitation Center (BBRC) in the city, he engaged in a large-scale shabu trade being conducted in the facility, and continued to do so even after he was transferred to New Bilibid Prison and later released.
Espinosa also admitted that he had engaged with Police Chief Inspector Wilfredo Abordo for a shabu deal worth P780,000 and a Toyota Fortuner vehicle owned by Baysay Custodio, who said in an affidavit that he was a “confidential asset” of the national police.
Espinosa and drug convict Peter Co have also been indicted of drug crimes in 2018.
The National Bureau of Investigation (NBI) also noted that the Senate did not grant legislative immunity to Espinosa, which he requested in 2016 so he can testify for the death of his father, Albuerra, Leyte Mayor Rolando Espinosa Sr.
The elder Espinosa was killed inside his jail cell in a shootout by police officers in 2016, while awaiting trial on charges of drug trafficking. The 19 cops who were involved in the killing were later reinstated.
Meanwhile, the complaints against the police officers – brought up by the younger Espinosa in his confession – were dismissed due to lack of sufficient evidence to establish probable cause.
