(August 5, 2022) – President Bongbong Marcos Jr. will no longer present any new proof or witness for a pending civil case involving his family’s ill-gotten wealth as he seeks to adopt the evidence earlier provided by his co-defendants, his legal counsel told the Sandiganbayan on Friday.
Atty. Manuel Plaza III informed the anti-graft court about the decision of Marcos but he needs to present a special power of attorney to prove that he was authorized to do so. Plaza will present the document during the continuation of the pre-trial hearing on August 10.
Plaza refused to provide any statement to the media.
In June, the second division of the Sandiganbayan allowed the Marcos heirs to present their evidence on Civil Case No. 0014 originally filed by the Presidential Commission on Good Government (PCGG) in 1987.
The Sandiganbayan turned down the motion filed by the Office of the Solicitor General that urged the anti-graft court to rule that the Marcoses have already waived their right to present evidence when they failed to appear in a hearing in August 2019.
Marcos was supposed to present his evidence last month but his camp sought to defer the proceedings as they asked for more time to review the documents.
“We asked the court for more time to look at the records because we want to make sure that the witnesses and records that we will present to the court will be admissible,” said Plaza last month.
The Sandiganbayan set the marking of documents yesterday but Marcos’ camp was unable to show any new evidence aside from the ones already presented by the other respondents. The pre-trial conference was scheduled for today.
Originally, it was the late dictator, former President Ferdinand Marcos Sr., who was named as one of the defendants in the case along with his wife, Imelda Marcos. His heirs were later substituted for him when he died in 1989.
Rebecco and Erlinda Panlilio, a couple who reportedly acted as cronies of Marcos, were also respondents in the case. Also included were Modesto Enriquez, Trinidad Enriquez, Erlinda Enriquez-Panlilio, Leandro Enriquez, Don Ferry, Roman Cruz Jr., and Gregorio Castillo.
Prosecutors alleged that the respondents used their close connection with Marcos to enrich themselves via the government through illicit schemes. The Panlilio couple was also accused of acting as dummies of Marcos to take control of firms such as the Ternate Development Corporation.
Only P174 billion worth of ill-gotten wealth of the Marcoses has been retrieved by the PCGG after several decades. At least P125 billion more is still under litigation.
Reports said the Marcoses accumulated $10 billion from public coffers during their kleptocratic rule. Aside from corruption, the dictatorship was also marred with cases of human rights violations that, until now, the Marcoses have refused to genuinely apologize for.
