(July 20, 2024) — Ahead of his third State of the Nation Address (SONA), Pres. Bongbong Marcos signed into law the New Government Procurement Act (NGPA) and the Anti-Financial Scamming Act (AFASA) at Malacañan on Saturday, July 20.
The Republic Act No. 12009 or the New Government Procurement Act (NGPA) ammended the Republic Act 9184 — the Government Procurement Reform Act which promotes transparency, competitiveness, efficiency, professionalism, accountability and sustainability in the government procurement process.
Marcos further highlighted the rigid yet shortened process of procurement processes from three months to only 60 days.
“The NGPA standardizes procurement forms and institutionalizes electronic procurement. One of the salient features of this law is the 11 new modalities of procurement, providing greater flexibility for government agencies in acquiring goods and services,” he explained.
“A key innovation of the NGPA is the introduction of the most economically advantageous responsive bid which aims to consider both qualitative and quantitative economic values of proposals. This is a shift from the current practice of selecting the lowest calculated and responsive bid,” Marcos added.
Pres. Marcos, Jr. also signed into law the Anti-Financial Scamming Act (AFASA), which addresses the rising tide on online scams.
“This law mandates financial institutions to implement necessary safeguards to protect our citizens’ accounts,” Marcos stated.
He emphasized the importance of this legislation in an era where cybercriminals use technology to defraud Filipinos, leading to personal economic losses and eroding trust in financial institutions.
“It will protect our people from falling prey to perpetrators targeting banks and e-wallet accounts,” Marcos added, underscoring the government’s commitment to enhancing financial security and trust.
AFASA, gives special power to the Bangko Sentral ng Pilipinas (BSP) to investigate and inquire cases involving financial accounts that may be fictitious.
Further, BSP may also apply cybercrime warrants for money muling activities and economic sabotage.
In sigining this law, the President hopes to deter the majority of the financial scams in the country while at the same time fostering greater trust in the government’s digitization efforts.
Moreover, these laws were part of Marcos’ previous SONA last July 24, 2023.
