(March 29, 2023) – The decision of President Bongbong Marcos Jr. to disengage with the International Criminal Court (ICC) following the rejection of one of his administration’s requests showed his lack of commitment to pursue accountability, a human rights organization said on Tuesday.
Karapatan maintained that the ICC probe is crucial in seeking justice over the inhumane war on drugs of former President Rodrigo Duterte.
“Marcos Jr.’s intransigence further exposes his government’s empty platitudes and rhetoric before the international community that the human rights situation in the Philippines is fine,” said Karapatan in a statement.
On Monday, the ICC appeals chamber found no compelling reason to heed the Philippines’ request to suspend the decision of the pre-trial chamber allowing ICC prosecutor Karim Khan to proceed with the investigation. The appeal itself, however, is still under review.
Marcos, who has close links to Duterte, announced the country’s continued disengagement from the ICC, reiterating issues with jurisdiction and sovereignty.
“In our view, there’s nothing more that we can do in the government. So, at this point, we are essentially disengaging from any contact, from any communication with the ICC,” said Marcos.
Solicitor general Menardo Guevarra, who served as Department of Justice secretary under Duterte, said he will explain to Marcos that their appeal has yet to be acted upon. But he maintained that the chief executive was justified in seeking to disengage from the ICC at this point.
“Now that the investigation will proceed, it seems there is no legal or even moral duty on our part to cooperate because that is the very issue that we are challenging before the appeals chamber,” said Guevarra on One News’ The Chiefs.
Despite the failed suspension bid, the ICC appeals chamber said the government can push through with efforts to prosecute the perpetrators.
Guevarra said nothing prevents the ICC from pursuing its probe, but he stressed that it cannot expect any support on the part of the administration.
“(Sa) presidente na nanggaling mismo that we will not cooperate at this stage. I have repeatedly stated that, at the very least, we have no legal obligation to cooperate at this time,” said Guevarra.
In the past, Marcos said he will not bring the Philippines back as a signatory to the Rome Statute after the country’s pullout, which was initiated by Duterte, took effect in 2019.
Karapatan said the administration’s consistent position showed its lack of sincerity to address the killings under Duterte’s bloody war on drugs, which human rights groups estimated at 30,000.
“It is becoming increasingly evident that Marcos Jr. has no intentions of exacting justice and accountability from the perpetrators and in fact, maintains the same policies and the same climate of impunity that had led Duterte and his minions to get away with murder,” said Karapatan.
