(June 05, 2024) – Senator Jinggoy Estrada on Tuesday filed Senate Bill No. 2703 or the Delayed Registration of Birth Act, aiming to institutionalize requirements and procedures for late birth registrations. The bill also proposes stricter penalties for providing false statements.
In his explanatory note, Sen. Estrada said this measure will make the procedure for delayed birth registration more effective. It will also ensure that birth certificates are genuine and truthful representations of a person’s identity.
The senator highlighted that around 3.7 million Filipinos lack birth certificates due to various reasons such as high costs, time constraints, unawareness of the necessity to register births, or complications in relationships surrounding the child.
He noted that the current system for late registration is vulnerable to abuse, necessitating the implementation of revised guidelines to prevent double registrations and ensure accurate records.
The bill is based on Joint Memorandum Circular No. 2021-01, issued by the Department of the Interior and Local Government (DILG) and the Philippine Statistics Authority (PSA) on October 18, 2021.
Penalties for false statements range from six months to 12 years of imprisonment and fines between 100,000 and 250,000 pesos.
Moreover, the proposed guidelines for delayed registration require the submission of the parents’ marriage certificate if the child is legitimate, and the parents’ birth certificates whether one parent is a foreigner or both are Filipino citizens.
Additionally, a mandatory field visit by the Office of the Punong Barangay where the child resides is required. The local civil registrar and the PSA will use digital media and channels to post notices to the public about pending applications for delayed registration.
For regular registrations, the law mandates that birth declarations must be submitted to the local civil registrar within 30 days of birth, including details such as the date, time, and place of birth, and the parents’ personal information.
