(July 4, 2022) – Lawmakers from the Makabayan bloc sought the repeal of the Anti-Terrorism Law (ATL) due to its “chilling effect” over the first two years of implementation, stressing how the measure contravenes human rights declarations that the Philippines had signed.
Representatives of Kabataan, ACT Teachers, and Gabriela are urging their colleagues to act on the proposal which they believe would be crucial following the concerns raised by human rights organizations and civil society groups.
“It is high time for Congress to do its part to ensure that this bill will not have the capability to harm any other person in this country,” said the groups in one of their priority proposals in the 19th Congress.
Kabataan Rep. Raoul Manuel noted that the ATL has also led to media censorship, referring to the blocking of websites of two alternative media organizations accused of having ties with the Communist Party of the Philippines. He further noted that the intimidation against civilians likewise rose.
“Kabataan views mounting cases of state agents weaponizing the law to threaten and imprison innocent civilians on top of producing dubious terror-tagging proscription lists as vindication of initial fears of petitioners and many Filipino citizens,” said Manuel in a statement.
Last December, the Supreme Court ruled that only two provisions of the controversial law are unconstitutional, including the phrase that covers a person’s intent in the definition of terrorism. It also agreed that the method of designation based on the request of supranational jurisdictions was unconstitutional.
Petitioners saw this as a partial victory considering that many other provisions of the ATL remain in effect. In April, the Supreme Court also threw out the motions for reconsideration due to the lack of “substantial issues” pointed out in the appeals.
The College Editors Guild of the Philippines (CEGP) backed the proposal of the Makabayan bloc to repeal the contentious legislation, which they described as a means to “institutionalize tyranny and fascism.” It added that the attacks may worsen under the term of President Bongbong Marcos Jr. given his stance on the ATL.
“ATL has only been utilized to trample freedom of expression, press freedom, and freedom to dissent,” said the CEGP. “(ATL) was also one of the reasons why trolling, red-tagging, surveillance, harassment, and even arrest of campus journalists happened in different universities and colleges.”
Karapatan has recorded at least 424 activist killings from July 2016 to November 2021. Some 1,159 individuals were illegally detained while more than 575,000 faced intimidation tactics under the term of former President Rodrigo Duterte, who emboldened law enforcers to attack dissenters with his iron-fisted style and tough-guy rhetoric.
“We have witnessed state authorities’ crackdown on activists, media, universities, etc. who advocate social justice and call out government deficiencies in addressing the present problems of our nation. These gradual attacks on democratic institutions signal a thinning of our democratic spaces,” added the proposal.
