(March 26, 2021) – An associate justice at the Supreme Court is planning to retire early due to health reasons, the high tribunal’s spokesperson said on Friday, giving President Rodrigo Duterte a chance to pick another magistrate.
Associate Justice Edgardo Delos Santos was expected to step down from the high court ahead of his 70th birthday on June 12, 2022, according to Brian Keith Hosaka, but it remained unclear when he will officially retire.
“He remains an incumbent member of the Supreme Court after a specific date of retirement, as may be indicated in a formal letter from him to the En Banc, is accepted and acted upon by the Court,” Hosaka told reporters.
Delos Santos, in a letter dated March 19, told his staff to find other jobs to prepare them for his retirement. Hosaka said the magistrate did not want his people to have a hard time finding other employment due to the coronavirus disease (COVID-19) pandemic.
But Delos Santos has yet to write to the Supreme Court en banc to formally inform them of his intention to retire early.
Prior to his appointment to the high court in December 2019, Delos Santos served as a Court of Appeals justice based in Cebu for more than 11 years. He earned his law degree from the University of San Carlos.
Chief Justice Diosdado Peralta also opted for an early retirement this month, with three candidates vying for the top post at the Supreme Court.
Peralta gave no reason for his retirement. His last day in the court is on Friday, March 26.
Duterte will choose between three candidates—Senior Associate Justice Estela Perlas Bernabe, and Associate Justices Alexander Gesmundo and Ramon Paul Hernando—to replace Peralta. The next Supreme Court chief justice will be the president’s fourth after 2016. One was ousted from office.
