(May 9, 2025) – The Department of Justice (DOJ) on Friday affirmed that the preliminary investigation into the kill remark of Vice Pres. Sara Duterte-Carpio against Pres. Bongbong Marcos Jr. was conducted under due process and followed the rule of law.
Earlier today, Duterte-Carpio attended the inquiry. She is facing complaints of inciting to sedition and grave threats filed by the National Bureau of Investigation. She filed a counter-affidavit.
“Vice President Duterte shall be given every opportunity to answer the allegations and to present her defense before the investigating prosecutors,” said the DOJ in a statement.
It furthered that the preliminary investigation is a “critical stage” to safeguard an individual’s rights against arbitrary prosecution.
“During this process, prosecutors shall carefully evaluate the evidence presented to determine whether prima facie evidence with reasonable certainty of conviction exists,” added the DOJ.
Duterte-Carpio’s legal counsel, Atty. Paul Lim, said she sought the dismissal of the complaints, which stemmed from an expletive-laced online rant in November.
The embattled vice president revealed that she already instructed an individual to kill Marcos Jr., first lady Liza Araneta-Marcos, and House Speaker Martin Romualdez if she were killed amid the continued investigation into her alleged misuse of confidential funds.

She repeatedly denied issuing a death threat, saying her statement was “maliciously taken out of logical context.”
Before that, she also told reporters that she imagined herself beheading Marcos due to their relationship becoming “toxic.”
Marcos and Duterte-Carpio, who repeatedly espoused unity during their campaigns in 2022, have publicly bickered after their UniTeam was dissolved.
In February, Duterte-Carpio was impeached by the House of Representatives due to multiple constitutional violations, including her kill remark.
Her impeachment trial in the Senate will begin in July.
